1. Introduction

Your rights to privacy and to protect your personal information are important to Business Consultants, Inc. ("BCon" or "we"). We recognize that when you provide us with information about yourself, you trust us to act in a responsible manner. BCon will collect and process the personal data of its website visitors in some cases: (i) where it is necessary to provide the visitor with sufficient services and products or where there are otherwise legitimate interests to BCon; (ii) where it is necessary for the performance of a contract between the visitor and BCon or for procedures prior to the execution of a contract; or (iii) where BCon has obtained the prior explicit consent of the visitor. 

The following discloses our information collection and usage practices for https://bconglobal.com and its sub-domains (collectively our "websites"). Although these websites may contain links to third-party websites, BCon is not responsible for the privacy practices followed by non-affiliated companies.

 

2. General Principles and Legitimization for Processing

“Personal Information” as used in this Privacy Policy means any information relating to an identified or identifiable natural person. Personal Information includes for example your name, your mailing address, your telephone number, your e-mail address or other information that identifies you or makes you identifiable. Information that by itself cannot be used to identify you or make you identifiable does not qualify as Personal Information. 

BCon will use Personal Information it has acquired for the purposes shown under the each item of Information We Collect stated below, as well as:  

  • To comply with legal obligations that BCon should abide by or to process it for public interests or during an operation to be conducted for exercising public authority granted to BCon; and 
  • To process it for legitimate interests which will be sought by BCon or a third party except where such interests is overridden by the interest of fundamental rights and freedom of the Personal Information.

   

3. Information We Collect

You may be visiting our websites for a variety of reasons. For the purpose of this Privacy Policy, we will classify these reasons as (i) Browsing, (ii) Submitting Forms and (iii) Creating a User Account. Please note that not all activities may be available on our websites at a given time. For each different type of activity, we collect and store different types of data for the following reasons. Further, when we use cookies, Cookie Policy shall be part of this Private Policy.

When you are browsing or navigating through our websites, we collect information about your computer and the pages you visit on our websites. The purpose of BCon's use of the Personal Information shall be as follows: 

To create research, an analysis or a report by us to enable us to improve the navigation and structure of our pages or the contents of pages (Web Analytics) so that we can provide more value when a visitor finds information more quickly or when they find what they are searching for on our website.

The provision of such Personal Information is not a legal requirement and you are not obligated to provide it; however, if required information, like browsing history, has not been provided, this may lead to an inability to provide, in whole or in part, services being provided by the BCon Website. (ii) Submitting Forms

Specific pages of our Website include an exclusive form by which the visitor provides contact information such as name, phone number and e-mail address.

The purposes of BCon’s use of such Personal Information are:

  • To enable you to transmit inquiries, information and feedback concerning our services and solutions;
  • To meet the visitor’s request for free consultation;
  • To enable you to receive survey result; and
  • With your consent, to provide you with various kinds of information related to our business, which aims to be of interest to you and your organization (includes marketing information).

Whether to provide the required information or not will be absolutely left to your determination. The provision of such Personal Information is not a legal requirement and you are not obligated to provide it. However, if the required information has not been provided, this may lead to an inability to provide, in whole or in part, services being provided by the BCon Website.
BCon keeps all information directly collected confidential and will use the information only for the particular purpose stated at the point of collection. BCon will seek your specific permission for any additional use. You may also unsubscribe from mailing lists on any of our site anytime. (iii) Creating a User Account

When setting up an account on the BCon Website (hereinafter referred to as the “User Account”), BCon may request the provision of Personal Information such as name, e-mail address and phone number. Furthermore, BCon may request entry of payment method details and an accurate address.

The purposes of BCon’s use of the Personal Information shall be follows:

  • To manage the participant’s information when the visitor takes part in an event to be held by BCon or its business partner and to provide products and services upon the request of the visitor;
  • When the visitor purchases a product, service or other goods being sold by BCon, to appropriately provide or deliver the said service, merchandise and the like or to conduct a billing operation;
  • To contact the visitor with respect to the account or a transaction with BCon and to transmit any changes in BCon’s policy; and
  • To provide support such as product updates, a change of service or any other similar information

In addition, BCon will use Personal Information of the visitor for legitimate interests of BCon such as conveying information relating to the function of BCon Website, the release of a new product and service development, or advertising BCon products and services, in accordance with this Privacy Statement (including but not limited pursuant to GDPR Article 6 paragraph 1 (f)).
The provision of such information is a requirement necessary for concluding a contract, by which BCon will provide services to the visitor including but not limited those who are a party under GDPR Article 6 paragraph 1 (b) . If the required information has not been provided, this may lead to an inability to provide, in whole or in part, services being provided by the BCon Website.
Any User Account data will be stored only until you decide to terminate your User Account. In case we are obliged to further store your Personal Information due to statutory retention requirements, your Personal Information will be barred from further use by BCon and will be stored only until such retention periods expire.

 

4. How We Treat Your Information

BCon understands the need for user privacy and maintains reasonable and appropriate security procedures to protect your information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into due account the risks involved in the processing and the nature of the Personal Information. The access given to employees is restricted to their need for such information for business purposes.

(i) Third-Party Information Storage 

We may share your Personal Information with third-party vendors, consultants and other service providers (for example website analytics companies, marketing software and others) to perform tasks on our behalf within the scope and extent as described in the Section “Information We Collect” . None of these service providers are allowed to use the Personal Information they receive from us for any other purpose than to perform the contracted services we have contracted them to perform. Like BCon, they will never barter, trade, or sell access to your information.
We are cooperating with our overseas subsidiaries, affiliate companies, and business partners to provide the best solution for our customers. For that reason, please be noted that one of our subsidiaries, affiliate companies, and/or business partners may take over the inquiry, and we may need to disclose the information received from the inquiry, which may include personal information. When selecting our business partners, we take into account their data handling processes.
BCon will also obtain your consent before sharing your Personal Information with any third party that is not acting as an agent or vendor to perform tasks on our behalf or to use the information for a purpose materially different from the purpose for which it was initially collected or subsequently authorized by you. An exception to this will be (among others) where BCon's processing of Personal Information is necessary for compliance with a legal obligation under an applicable law.
If we decide to sell, buy, merge or otherwise reorganize businesses in some countries, such a transaction may involve the disclosure of Personal Information to prospective or actual purchasers, or the receipt of such information from sellers. It is our practice to require appropriate protection for Personal Information in these types of transactions.

(ii) Data Retention Policy 

BCon retains personal data, as necessary, for the duration as the purpose of the collection reasonably and appropriately requires. We may also retain personal data for longer than the duration as the purpose of the collection reasonably and appropriately requires should we need to retain it to protect ourselves against legal claims, use it for analysis or historical record-keeping, or comply with our information management policies and schedules when laws applicable to BCon require. If you request that we delete your personal data, BCon will make reasonable attempts to delete all instances of the information in its entirety. (iii) User Forums 

You should be aware that whenever you publicly disclose information online, information could be collected and used by others. BCon is not responsible for any action or policies of any third parties who collect information that users publicly disclose in any such forums on our websites.

■ Special Information for web-site visitors who are in the European Union (EU)

Beginning May 25, 2018, the processing of personal data of web-site visitors who are in the EU is subject to the EU General Data Protection Regulation (“GDPR”). This section provides information as relates to web-site visitors who are in the EU' rights and BCon's responsibilities, under this regulation. 

 

1. Rights of web-site visitors who are in the EU
Where it is recognized by laws applicable to BCon and web-site visitors who are in the EU, the visitor shall have the following rights:

  1. Right of access
    The visitor shall have the right of access to the purpose of processing of the collected personal data, categories of the personal data stored, the storage period and the like.
  2. Right to rectification and right to erasure
    The visitor shall have the right to obtain from BCon the rectification and erasure of Personal Information he or she has provided without undue delay.
  3. Right to restriction of processing
    The visitor shall have the right to cause BCon, under certain circumstances, to restrict processing for a period enabling BCon to verify the accuracy of the personal data.
  4. Right to data portability
    The visitor shall have the right to receive from BCon Personal Information he or she has provided in a structured, commonly used and machine-readable format and shall have the right to transmit the said data to another company.
  5. Right to object
    The visitor shall have the right to object against BCon, at any time, to the processing of Personal Information he or she has provided.
  6. Automated individual decision-making, including profiling
    The visitor shall, except for cases provided for in GDPR Article 22 paragraph 2 and 3, have the right not to be subject to decisions based solely on automated processing, including profiling which produces legal effects concerning him or her or similarly significantly affects him or her.
  7. The right to lodge a complaint with a supervisory authority
    Where it is recognized by laws applicable to BCon, the visitor shall have the legal right to lodge a complaint with a data protection authority.

BCon reserves the right to charge an appropriate fee for complying with your request where allowed by applicable law, and/or deny your requests where they may be manifestly unfounded, and/or excessive, or otherwise objectionable or unwarranted under applicable law.
You shall also be entitled to revoke, at any time toward the future, the consent you have given to BCon concerning the provision of Personal Information.

 

2. Privacy Policy Updates
If we make material changes to this Privacy Policy that increase our rights to use personal data that we have previously collected about you, we will obtain your consent either through an e-mail to your registered e-mail address or by prominently posting information about the changes on our sites.

 

3. Children
BCon websites are not designed for or directed at children 16 years of age or younger, and BCon does not intentionally collect or maintain personal data regarding anyone under this age.

 

4. Notice to the Visitor When Personal Information Is Infringed
In the event the personal data of the visitor are infringed and the infringement may trigger a high risk to the visitor’s rights and freedom, BCon will, without undue delay, notify the data subject of the personal data infringement.
